1. Who We Are
Christopher Paul Osborne (ABN 71 970 982 034), trading as Active OzeWine Services ("OzeWine", "we", "us"), operating from 81 Stephen Road, Botany NSW 2019. OzeWine is a third-party wine logistics business: we store, handle and deliver wine on behalf of wine businesses and licensed venues across metropolitan Sydney.
We do not sell wine. Stock in our care remains the property of our clients at all times. Nothing on this website is an offer to sell liquor.
2. The Services
Warehousing and storage of packaged wine at our Botany facility
Transport and delivery to pubs, clubs, bars, restaurants, retailers and other venues across metropolitan Sydney
Receiving, checking, labelling and handling of consignments
The scope of services, rates and any special requirements for each client are agreed in writing per engagement. These website terms do not replace a client service agreement; where the two differ, the service agreement prevails.
3. We Are Not a Liquor Retailer
OzeWine does not sell or supply liquor on its own account and does not hold a packaged liquor licence, because a storage and delivery provider does not sell liquor. Every sale of the wine we carry is made by our client under that client’s own liquor licence. Our responsible-delivery practices are set out in our Responsible Alcohol Delivery statement.
4. Care of Goods
We handle and store goods with reasonable care and skill. Clients must declare any special storage or handling requirements in writing before goods arrive at our facility.
5. Loss or Damage
Claims for goods lost or damaged while in our care are handled under our Claims policy. Notify us within 7 days of the delivery or the discovery of the issue.
6. Australian Consumer Law
Where the Australian Consumer Law applies, our services come with guarantees that cannot be excluded, including that services will be provided with due care and skill. Nothing in these terms excludes, restricts or modifies any right that cannot lawfully be excluded. Otherwise, to the maximum extent permitted by law, our liability for a failure in the services is limited to supplying the services again or paying the cost of having them supplied again.
7. Insurance
Storage and carriage do not transfer ownership. Clients remain responsible for insuring their own stock, and should confirm their cover extends to goods in storage and in transit.
8. Privacy
Personal information is handled in accordance with our Privacy Policy at https://ozewine.com.au/privacy.
9. Changes to These Terms
We may update these terms from time to time. The current version is always at https://ozewine.com.au/terms.
10. Governing Law
These terms are governed by the laws of New South Wales, Australia.
